1. About the App

The Wainwright Companion is a mobile application for tracking completion of the 214 Wainwright fells in the English Lake District. These terms govern your use of the app and its features.

Weather and navigation data are provided for informational purposes only. They should not be relied upon as your sole source of safety information when walking in the fells.

You are responsible for your own safety on the hills.

Weather data is provided by the Met Office and Open-Meteo and may not reflect actual summit conditions. GPS accuracy varies and the app may lose signal in remote areas. Route information is computer-generated and cannot account for all terrain hazards, path closures, or seasonal conditions.

The app is provided “as is” without warranty of any kind. We are not liable for any loss, injury, or damage arising from use of the app, its navigation features, or its weather data.

4. User Content

You retain ownership of all content you create in the app, including notes, photos, and completion records.

By sharing completions publicly through the app’s social features, you grant a limited, non-exclusive licence to display that content within the app to other users. You can revoke this by unsharing individual completions or disabling social sharing in Settings.

5. iCloud & Data

The app uses Apple iCloud (CloudKit) to sync your data across devices and to power social features. Your use of iCloud is subject to Apple’s own terms of service.

We are not responsible for data loss due to iCloud service interruptions or account issues. We recommend keeping your iCloud account in good standing.

6. Account Deletion

You can delete your account and all associated data at any time using the Delete Account option in Settings. This action is permanent and removes your data from both your device and iCloud.

7. Termination

We reserve the right to remove accounts or content that violate these terms, or to suspend access to social features for users who misuse them.

8. Changes to These Terms

We may update these terms from time to time. Changes will be reflected on this page with an updated date. Continued use of the app after changes constitutes acceptance of the updated terms.

9. Governing Law

This licence is governed by the laws of England and Wales. If you are a resident of the European Union, European Economic Area, or Switzerland, the law of your usual place of residence applies to any dispute arising from this licence, and any such dispute shall be subject to the courts of that place of residence..

11. App Store Licence Terms

The following terms apply specifically to your use of The Wainwright Companion when downloaded from Apple’s App Store. They supplement the terms above and are required by Apple Inc.

a. Acknowledgement

This licence is concluded between you and Paul Dickenson (“the Developer”), not with Apple Inc. (“Apple”). The Developer, not Apple, is solely responsible for the Application and its content.

b. Scope of Licence

The Developer grants you a non-transferable licence to use the Application on any Apple-branded products that you own or control, subject to the Usage Rules in Apple’s App Store Terms of Service. You may not distribute or make the Application available over a network where it could be used by multiple devices simultaneously, and you may not transfer, sublicense, or otherwise make the Application available to any third party.

c. Maintenance and Support

The Developer is solely responsible for providing maintenance and support services for the Application. Apple has no obligation whatsoever to provide any maintenance or support services with respect to the Application.

d. Warranty

The Developer is solely responsible for any product warranties, whether express or implied by law. In the event of the Application failing to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Application. All other claims, losses, liabilities, or damages arising from a failure to conform to any warranty are the Developer’s sole responsibility.

e. Product Claims

The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your use of it, including: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

f. Intellectual Property Rights

In the event of any third-party claim that the Application or your possession and use of it infringes that third party’s intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of that claim.

g. Legal Compliance

You represent and warrant that: (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

h. Third-Party Terms

When using the Application you must comply with any applicable third-party terms of agreement. For example, you must not be in violation of your wireless data service agreement when using the Application’s GPS or data features.

i. Third-Party Beneficiary

Apple and Apple’s subsidiaries are third-party beneficiaries of this licence. Upon your acceptance of these terms, Apple has the right to enforce this licence against you as a third-party beneficiary.
